Reading bank lending standards before requesting CRE debt

Classify regulatory requirements, supervisory limits, bank policy and negotiated terms before treating a published number as available commercial leverage.

Illustrative examples. This is a constructed educational scenario, not a reported Jaken Finance Group transaction or financing offer.
The decision in brief

A supervisory lending limit is not a loan offer. Identify who the provision governs, which transaction it covers and how the bank’s own policy and underwriting further constrain the request.

When a lender says a transaction exceeds its limit, ask which limit. A regulatory provision, supervisory guideline, internal policy and transaction-specific credit decision are different pieces of evidence. Finding a higher number in a public document does not establish that the bank must lend that amount.

The useful borrower response is a classification exercise: identify the source, its addressee, the relevant transaction category and the evidence needed for a different decision. This makes a financing conversation more precise than debating a percentage without its context.

Read the obligation before extracting the number

12 CFR 34.62 requires national banks to maintain written real-estate lending policies, including underwriting and administration controls. The associated interagency guidelines discuss internal LTV limits, credit factors and exceptions. Those materials describe a lending framework; they are not an application form granting a borrower a specified advance.

Start with the identity of the institution and its regulator. Do not apply a national-bank citation to every private lender, credit union or public lending program without checking applicability. Even where comparable regulatory frameworks exist, cite the actual governing source rather than assuming identical scope.

Classify a statement in the credit file

Statement Classification to verify Evidence that would resolve it
“The rule requires us to maintain underwriting standards” Requirement addressed to the institution Applicable regulation and institutional scope
“The supervisory table shows a limit for this category” Supervisory benchmark with definitions and exceptions Current table, category and accompanying text
“Our policy permits no more than 60% for this property type” Bank-specific policy statement Written explanation of the applicable policy and exception authority
“Credit supports only $4.5 million on this property” Transaction-specific underwriting outcome Accepted income, value, structure and binding constraint
“We can consider an exception” Conditional review process Required evidence, approving authority and written result

The borrower may not receive the bank’s full internal policy. A precise written explanation of the applicable constraint can still be useful. Record what was actually confirmed and leave undisclosed details unknown.

Worked example: three limits, three different questions

Assume an $8 million improved commercial property and a $5.6 million financing request. For this illustration, all figures use the same accepted value and there are no other liens. The public guideline’s improved-property supervisory LTV is 85%, which corresponds arithmetically to $6.8 million. The guidelines also explain that reaching a supervisory limit does not automatically make a loan sound.

Now assume this bank reports an internal 60% LTV ceiling for the transaction. That ceiling corresponds to $4.8 million, leaving $800,000 between the request and the policy-sized amount. The fact that $5.6 million is below $6.8 million does not eliminate the bank’s more restrictive decision.

Finally assume its cash-flow underwriting supports only $4.5 million. The immediate financing gap becomes $1.1 million relative to the requested debt. Even a policy exception allowing $4.8 million would leave the cash-flow constraint unresolved. The two issues require different evidence.

Question Relevant amount Borrower response
What does the supervisory table imply under the assumed category/value? $6.8 million Verify scope and definitions; do not call it offered proceeds
What does the stated bank policy allow? $4.8 million Ask whether an exception process exists and what supports it
What does accepted cash flow support? $4.5 million Reconcile income and debt-service assumptions or change capital structure

All bank policy and underwriting figures here are hypothetical. The exhibit is not a statement of current lender appetite.

Prepare an exception request that addresses the actual issue

An exception memo should identify the precise deviation, its size and duration, the evidence supporting repayment and the remaining uncertainty. Separate verified mitigants from future actions. Cash already deposited is different from a planned equity raise; an executed lease is different from an unaccepted proposal.

Avoid arguing that a proposed exception is harmless because another lender might accept it. Explain the property and sponsor facts that bear on the stated weakness. If the weakness is liquidity, show unrestricted funds and competing obligations. If it is repayment capacity, a larger collateral estimate may not resolve the immediate cash shortfall.

The interagency framework recognizes exceptions in appropriate circumstances, with institutional controls. That does not create an obligation to approve one. Keep the financing plan conditional until the bank communicates an actual decision and remaining requirements.

Distinguish an underwriting assumption from a contract test

A bank may test a stressed rate, different amortization or adjusted cash flow when deciding how much to lend. The executed loan may later define a reporting covenant differently. Preserve both calculations instead of replacing one with the other because the labels are similar.

Ask which calculation caused the current financing constraint and which calculation will govern ongoing obligations. The answer affects the borrower’s response: improving a submission, contributing equity, changing requested terms or preparing a post-closing reporting process.

Keep the final conclusion narrow

A useful decision note states the requested amount, verified constraint, supporting source, unresolved questions and next action. It does not label every decline a regulatory prohibition, and it does not treat the absence of a prohibition as approval.

If another financing channel is considered, evaluate its actual proceeds, obligations, cost and exit. The original bank’s limit remains evidence about that bank’s decision. It is not a universal valuation of the property or a promise that a different provider will close.
