Does this loan require an appraisal? Verify the rule, exception and lender policy

Use a source-applicability worksheet to separate a bank appraisal threshold, required evaluation, program requirement and lender policy without confusing loan amount with property value.

Illustrative examples. This is a constructed educational scenario, not a reported Jaken Finance Group transaction or financing offer.
The decision in brief

An appraisal exception does not necessarily remove the need for a valuation. Identify the institution, transaction category, defined transaction value and lender/program requirements before selecting a report.

A borrower asking whether an appraisal is required needs more than a loan amount. The answer depends on the institution, the transaction category, the applicable rule and exceptions, and any separate program or lender requirement. A report ordered before those facts are resolved may not satisfy the party that must rely on it.

The first decision is therefore which requirement you are trying to satisfy. Regulatory appraisal requirements, an appropriate evaluation, investor underwriting and the borrower’s own acquisition diligence are related but different tasks.

Use one regulation as a scoped example

The Federal Reserve’s reproduction of 12 CFR 225.63 provides a useful example. Paragraph (a)(14) addresses covered CRE transactions with transaction value of $500,000 or less. Paragraph (b) still requires an appropriate collateral evaluation for that exception, and paragraph (c) preserves authority to require an appraisal for safety-and-soundness concerns.

The associated definitions distinguish CRE transactions from those secured by a single 1–4 family residential property. For a loan, transaction value means the amount of the loan or extension of credit. These details prevent two common mistakes: treating every business-purpose property loan as the same category and comparing the threshold with purchase price instead of the defined transaction amount.

This example is confined to the cited regulation’s scope. It does not establish the rule for every bank, private lender, credit union, agency execution or state-law setting. Confirm the applicable framework before applying the example to a real financing request.

A requirement worksheet before ordering a report

Field Evidence to capture Why it changes the decision
Lending entity and institutional scope Legal entity and applicable regulator/rule A familiar lender brand may contain different entities
Transaction classification Collateral, purpose and relevant definitions Residential/CRE or other classifications can differ from marketing language
Defined transaction value Loan or other measure specified in the rule Purchase price may be the wrong threshold input
Claimed exception Exact paragraph and facts satisfying each condition A headline exemption can omit an evaluation requirement
Program or investor requirement Current guide, commitment or written instruction A regulatory exception does not waive another applicable requirement
Lender’s final instruction Report type, scope, commissioning process and reliance The selected report must serve the actual intended use

Assign a person to resolve each open field. “Appraisal waived” is not a complete entry unless the file identifies what was waived, by whom, under which authority and what valuation work remains.

Two hypothetical files expose the threshold error

FileA proposes a $450,000 loan on a property purchased for $900,000. Assume the lender and transaction fall within the cited CRE rule, and the stated loan amount is the relevant transaction value. The arithmetic LTV is 50%, but that ratio is not the appraisal-exception test. The threshold comparison uses $450,000, not the $900,000 purchase price.

Under those narrowly stated assumptions, the cited threshold exception may be relevant. It does not support a conclusion that no valuation is needed: the evaluation requirement remains part of the source analysis, and other applicable requirements still need review.

FileB proposes a $510,000 loan. That amount exceeds the example’s $500,000 threshold by $10,000. It does not fit that particular threshold exception. This page does not infer that no other exception can apply; the complete rule and facts must be evaluated. Nor should the borrower split or relabel a transaction in the model to manufacture a preferred result.

The outcome of this exercise is a documented classification, not a lender approval. Keep both files marked unresolved until the responsible lender confirms its actual valuation requirement.

An evaluation is a separate deliverable

An exception from a specified appraisal requirement should not be translated into permission to submit any broker opinion, automated estimate or owner spreadsheet. Ask what constitutes an acceptable evaluation under the applicable framework and the lender’s process. Identify who prepares, reviews and accepts it.

Similarly, a recent appraisal from another transaction may have different intended users, value premises or assumptions. Before paying for updates or relying on a transfer, obtain the lender’s written requirements for acceptance, review and any reliance arrangements. The age of the report is only one relevant fact.

Write the assignment around the financing question

Separate the subject interest and property from the business plan. Identify whether the requested analysis concerns current condition, completion or stabilization, and the relevant effective date. A prospective value does not establish that today’s collateral has already reached that condition.

The lender should confirm the report it requires, but the borrower can help prevent factual omissions by providing complete leases, amendments, operating records, property descriptions and capital plans through the proper channel. A request to correct an omitted lease is different from a request to reach a target value.

Keep source versions and decisions together

Save the applicable rule section and the retrieval date, any program guidance, and the lender’s instruction in the same evidence record. Record whether a conclusion came from a current rule, a historical press release or an individual lender policy. An old announcement can explain a change without establishing that no later change occurred.

If the structure, collateral or loan amount changes, revisit the worksheet. A valuation decision made for one transaction should not be carried into a materially different transaction without review. The completed record should let another reviewer understand why the selected report is appropriate and what remains outside its scope.
